Ketidakpastian Status Lahan dan Potensi Deforestasi Dalam Wacana Pembangunan Bandar Antariksa Biak
Abstract
The era of Joko Widodo's presidency administration is known for its rapid economic breakthroughs. In December 2020, the Indonesian government was said to have offered Biak Island as a spaceport or cosmodrome to the founder of Space Exploration Technologies Corporation (SpaceX), Elon Musk (The Guardian, 2021). This paper provides significant arguments based on the normative legal research method which refers to Indonesian land and forestry legal regulations and directives to build a more contextual analysis and combining the anthropology (ethnohistory) studies to discover cultural-environmental nexus inside Biak customary law community through examining historical anthropological literature. The problem stems from the uncertainty of land status. Land disputes have also led to the unclear status of the above-ground forest. Alternative dispute resolution approach should be prioritized to reach a mutually beneficial agreement – due to it involves indigenous and environmental rights all at once. Spaceport development discourse shall endeavor embodiment of socio-cultural and environmental balanced alignments, besides economic that was always solicitous about.
